Terms of Service

outpoof is a software service that generates print-on-demand (POD) design files from structured briefs (niche, optional sayings, style preferences). Output files are transparent PNGs intended for merchandise upload workflows (e.g. Merch by Amazon, Etsy, Redbubble).

Pay-on-approval model: submitting a brief and generating previews is free. Credits are deducted only when you explicitly approve a design. Downloading an approved design does not incur an additional credit charge.

• You must be at least 18 years old.
• One account per natural person. Duplicate or abusive accounts may be suspended.
• You are responsible for securing access to your email inbox used for login.
• You must provide accurate contact information and keep it current.

• Credits are sold in prepaid packs via Stripe Checkout. Prices are shown in USD; German VAT may apply at checkout where required.
• Credits are non-transferable, have no cash value, and do not expire.
• New accounts may receive a one-time welcome grant of 5 credits after email verification. Welcome credits are promotional and non-refundable.
• Purchased credit packs are final once payment succeeds, except where mandatory law requires otherwise.
• Auto top-up (optional): you must actively accept a separate authorization on the Billing page before it is enabled. You choose a balance threshold and pack size. When your balance falls below the threshold, we charge your saved card for that pack via Stripe until you disable the feature. Consent version, timestamp, and request metadata are logged for billing disputes.
• Stripe invoices and receipts are issued according to your billing profile and Stripe settings. Tax IDs collected at checkout may appear on invoices.

Credit pack purchases are generally non-refundable. If an entire generation job fails due to a fault on our side before you approve any design, no credits are consumed for that job. Billing errors (duplicate charge, credits not delivered after successful payment) may be reported to hi@outpoof.com with payment reference and account email. We investigate within a reasonable timeframe.

Before you approve a design: outpoof (Erik Drennan, Einzelunternehmer) (outpoof) retains all rights, title, and interest in each generated design and preview file. Previews are watermarked and provided for evaluation only. You may not download, copy, scrape, or otherwise obtain full-resolution output files except through the Service after you explicitly approve a design and the applicable credits are charged. You may not remove, obscure, crop out, or circumvent preview watermarks, or use any technical means to access unapproved full-resolution files (including browser tools, automated scripts, or guessing storage URLs).

After approval and credit charge: you receive a non-exclusive right to use the corresponding full-resolution output file for commercial purposes, including POD listings. Downloading an approved design does not incur an additional credit charge; re-downloads of the same approved file remain permitted. outpoof does not claim ownership of approved outputs once you have paid the approval credits. AI outputs may resemble existing works; we do not warrant non-infringement or platform acceptance.

You are solely responsible for compliance with trademark, copyright, and marketplace rules (including Merch by Amazon content policies). You bear all risk from listing, selling, or distributing designs. To the fullest extent permitted by law, you agree to indemnify outpoof and its operators against claims, losses, and reasonable legal fees arising from your use or listing of generated designs.

• No illegal, defamatory, hateful, or sexually exploitative content requests.
• No downloading, exporting, or use of full-resolution designs without prior approval and credit charge through the Service.
• No removal or circumvention of preview watermarks, and no attempts to access unapproved full-resolution files.
• No circumvention of daily generation limits or credit abuse.
• No resale of API or account access without written permission.
• No reverse engineering of models, prompts, or pipeline internals.

The Service is provided "as is" and "as available." Maintenance, third-party outages (OpenAI, hosting, payment processors), and quality variance may occur. Credits are not refunded for downtime. We may modify features, pricing, or these Terms. Material changes will be announced by email at least 14 days before taking effect where practicable. Continued use after the effective date constitutes acceptance.

Design files are stored in private cloud storage with time-limited download links. We may delete inactive account data after extended inactivity with prior notice. See our Privacy Policy for retention schedules and deletion rights.

To the maximum extent permitted by applicable law, our aggregate liability for claims relating to the Service is limited to the fees you paid for credits in the 30 days before the event giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages. Mandatory consumer rights under German law remain unaffected where applicable.

You may stop using the Service at any time. We may suspend or terminate accounts for breach of these Terms. Unused credits are forfeited on termination unless required otherwise by law.

These Terms are governed by the laws of Germany. Courts in Germany have exclusive jurisdiction for business users. Consumers resident in the EU/EEA may retain mandatory protections of their home country.
